Description

Legislation concerning employers' obligations to provide accrued sick time to employees is undergoing rapid changes.

What began as localized city legislation has now transitioned to broader state mandates, exemplified by California's stringent regulations that employers must adhere to. Employees facing wage loss due to illness or non-work-related accidents are entitled to receive disability payments, commonly referred to as third-party sick pay.

In this CPE Course, we'll delve into the obligations and regulations surrounding sick pay for employers. When employees are unable to work due to personal illness or injury, employers often provide wage protection. Sick pay distributed directly by employers is typically considered standard wages, subject to federal employment tax withholding. It will also cover the employer's need to understand the tax implications associated with sick pay. Notably, FICA (Federal Insurance Contributions Act) taxes apply to such payments only for six months.

Key topics:

  • Overview of Paid sick leave
  • State-by-state requirements
  • Local requirements
  • NJ State Disability

Learning Objectives

  • Discuss state and city reviews of the current legislation on sick accruals that must be provided to employees.
  • Determining W-2 reporting requirements for third-party sick pay.
  • Determining what tax should be withheld and reported and by whom.
